Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the dmexadsnr website and related pages (the “Site”), operated by dmexadsnr Education s.r.o. (“dmexadsnr”, “we”, “us”, or “our”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, do not use the Site. The Site is intended for users aged 16 and over. If you are under 16, you may use the Site only with the involvement and supervision of a parent or legal guardian.

1. Educational Nature of the Site

The Site provides educational content about vegetable growing, including course outlines, gardening techniques, and seasonal growing tips. All content is provided for general educational information only. Gardening outcomes depend on many variables, including local climate, microclimate, soil structure, amendments used, pest and disease pressure, and the grower’s experience.

We do not guarantee harvest size, crop quality, or timing. Any examples (including sowing windows, spacing, or storage guidance) are illustrative and must be adapted to your conditions and local regulations. Where products or interventions are referenced, you are responsible for following the manufacturer’s instructions and any applicable legal requirements.

2. Service Description and Changes

The Site may include registration forms that allow you to express interest in our vegetable growing courses. We may also provide downloadable or viewable learning materials, schedules, and informational pages.

We may update, modify, suspend, or discontinue any part of the Site at any time, including features, content, or availability, without notice. We aim to keep the Site accessible, but we do not promise uninterrupted availability or that the Site will be free from errors.

3. Registration Form and Communications

When you submit a registration or enquiry form, you agree to provide accurate and current information. We typically request only your name and email address so we can respond to your enquiry and share course-related information you asked for.

You must not submit information that is misleading, unlawful, or that you do not have the right to provide. You also agree not to use the form to send spam, phishing messages, or content designed to disrupt our systems.

4. Acceptable Use

You agree to use the Site lawfully and in a way that does not harm, disable, overburden, or impair the Site. In particular, you agree not to:

  • Attempt to gain unauthorised access to the Site, servers, or related systems.
  • Bypass or attempt to bypass security, rate limits, or access controls.
  • Use automated means (including bots, scrapers, or crawlers) to access or collect content without our permission.
  • Introduce malware, code, or content intended to disrupt, damage, or intercept data or systems.
  • Impersonate any person or entity, or misrepresent your affiliation with dmexadsnr.
  • Submit false information through forms, including fake names or email addresses you do not control.
  • Use the Site in violation of applicable export controls or sanctions laws.

5. Intellectual Property

The Site, including its design, text, graphics, layouts, lesson descriptions, and all other content, is owned by dmexadsnr Education s.r.o. or licensed to us and is protected by intellectual property laws. Our name and branding are trademarks or trade dress of dmexadsnr.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for your personal, non-commercial educational purposes. You may not copy, reproduce, distribute, modify, publish, create derivative works from, or exploit any portion of the Site without our prior written permission, except where such use is permitted by mandatory law.

6. Third-Party Services and Links

The Site may reference third-party services or resources (for example, general gardening resources or tools). Any third-party websites are not under our control. We do not endorse, monitor, or assume responsibility for third-party content, policies, or practices.

Your interactions with third-party services are governed by their terms and policies. You are responsible for reviewing those terms and for taking any steps needed to protect your devices and data.

7. Disclaimer of Warranties

The Site and all content are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site or servers are free of viruses or other harmful components. Any reliance on Site content is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, dmexadsnr Education s.r.o., its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.

To the extent permitted by law, our total liability for any claim arising out of or relating to the Site will not exceed the greater of: (a) the amount you paid to us in the twelve (12) months before the event giving rise to the claim, or (b) €100.

Nothing in these Terms limits or excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, where such exclusions are not permitted.

9. Indemnification

You agree to indemnify and hold harmless dmexadsnr Education s.r.o. from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site, (b) your violation of these Terms, or (c) your submission of unlawful, misleading, or infringing information.

10. Force Majeure

We will not be liable for any delay or failure to perform resulting from events beyond our reasonable control, including natural disasters, severe weather, acts of government, war, terrorism, labour disputes, pandemics, internet outages, cyberattacks, cloud provider failures, or disruptions to telecommunications or power.

11. International Use

We operate from the Czech Republic. We make no representation that the Site is appropriate or available for use in every location. If you access the Site from outside the Czech Republic, you do so on your own initiative and are responsible for compliance with local laws.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Czech Republic, without regard to conflict of law principles. Where you are a consumer and mandatory consumer protection laws in your country of residence apply, those mandatory rights remain unaffected.

Unless mandatory law provides otherwise, courts with jurisdiction in the Czech Republic will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Site.

13. Dispute Resolution (Informal First)

Before filing a formal claim, you agree to contact us and attempt to resolve the dispute informally for at least thirty (30) days. This step often resolves misunderstandings quickly, especially when the issue is related to communications, content clarity, or registration enquiries.

14. Termination

We may suspend or terminate your access to the Site if we reasonably believe you have violated these Terms or have used the Site unlawfully or abusively. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law will survive termination.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and dmexadsnr regarding your use of the Site and supersede any prior or contemporaneous understandings on the same subject.

17. Assignment and No Waiver

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, or sale of assets. You may not assign your rights or obligations under these Terms without our prior written consent.

If we do not enforce any part of these Terms, that does not mean we waive our right to enforce them later.

18. Modifications to These Terms

We may update these Terms from time to time. Changes will become effective fourteen (14) days after posting on this page, unless a change is required by law or is necessary for security reasons, in which case it may take effect immediately. Your continued use of the Site after the effective date constitutes acceptance of the updated Terms.

19. Electronic Communications

By using the Site and submitting forms, you consent to receive communications from us electronically (for example, by email). You agree that electronic communications satisfy any legal requirement that such communications be in writing.
